Tech&Law Breakfast: “Takedowns” on digital platforms. A balancing of fundamental rights?

My research and this talk will discusses the fundamental rights aspects of the contractually based “notice and takedown procedures” (NTD procedures). These procedures that are widely applied by the operators of online marketplaces are on the one hand very effective enforcement tools for the rightholders, but on the other hand they give rise to consider whether they strike “a fair balance” between the fundamental rights of the parties to the procedures i.e. of the operators of the online marketplaces, the vendors of the goods on the marketplace and the rightholders whose rights may be infringed by the offered goods.
