Legal implications of Big Data in Danish Healthcare

Health data, from sequenced genetic data to biometric information, is collected and analysed with greater intensity and frequency than ever. Digital tools, including electronic patient records, synchronised clinical registries, and wearable devices drive these developments. Health ministries and private companies claim that health tech will yield benefits for the individual and collective, namely personalised treatment that leads to better health outcomes and fewer costs for the welfare state. But, what other implications do the growing array of health technologies trigger for the person and the state?

This presentation will focus on current applications of big data in Danish healthcare system, drawing on recent developments including the National Genome Centre and the Sundhedsplatform. To what extent does existing legislation, namely, the Health Law Act, and the General Data Protection Regulation, enable the use of cutting edge technologies in the Danish healthcare system for the benefit of the collective? And, is the individual, whether patient or research subject, adequately protected by the current legal regime, or do we need new legal norms? The talk draws on ongoing research in two interdisciplinary projects: Personalised Medicine in the Welfare State (MeinWe) and PolicyAid.

Mette is professor and director of the Centre for Legal Studies in Welfare and Market (WELMA). Katharina is PostDoc at the Centre for Legal Studies in Welfare and Market (WELMA).
